Terms and Conditions
Le Foyer Tours (LFT) provides an online platform that connects operators who have knowledge and experience with a particular travel destination or activity with Travellers seeking to experience such destinations and activities.
The Services are accessible at www.lefoyertours.com and any other websites through which LFT makes the Services available and any related applications.
By using the Services, you agree to comply with and be legally bound by the terms and conditions of these Terms of Service and the Terms and Conditions of any operator with whom you make a booking. If you do not agree to these Terms, you have no right to obtain information from or otherwise continue using the Services.
YOU UNDERSTAND AND AGREE THAT LFT IS NOT A PARTY TO ANY AGREEMENTS ENTERED INTO BETWEEN OPERATORS AND TRAVELLERS, NOR IS LFT AN AGENT OR INSURER. LFT HAS NO CONTROL OVER THE CONDUCT OF OPERATORS, TRAVELLERS AND OTHER USERS OF THE SERVICES OR ANY TOURS, AND DISCLAIMS ALL LIABILITY IN THIS REGARD.
LFT is not an operator of tours, activities or other trips, nor is it a provider of tours or activities and LFT does not own, sell, resell, furnish, provide, manage and/or control any transportation, tour or travel services.
LFT’s responsibilities are limited to: (i) facilitating the availability of the Services and (ii) serving as the limited agent of each Operator for the purpose of accepting payments from Travellers on behalf of the Operator.
Providers' Terms and Conditions
1. By purchasing this tour from any tour or experience via Le Foyer Tours you agree to be bound by the following terms and conditions. In these terms and conditions references to “you” or “your” mean the purchaser of the tour and/or the passenger using the ticket as the case may be.
2. Tour tickets are valid for the time and date as stated on the confirmation only.
3. Tour tickets are single use only.
4. All tour tickets are non-transferable and can only be used in the name of the passenger given at the time of reservation.
5. Changes to the date or time of a reservation can be made up until 5:00pm (Arequip time) on the day prior to the beginning of the tour for no additional fee, subject to availability. Change requests must be via email to tours@hlefoyer.com and received prior to the aforementioned time.
6. Non-notification of a desired change or notification for a change after this time: will result in not being eligible for a change of tour date or any refund.
7. No Shows & Cancellations of this tour - If you cancel before 5:00 pm (Lima time) the day before the tour begins, there is a 10% administration fee (+ the card fee). After this time, there is a 100% no show or cancellation fee.
You must email tours@hlefoyer.com (include the name of the tour and the reservation number) to cancel this tour or to make any changes. Non-notification of cancellation or notification of cancellation after this time: will not be eligible for any refund.
8. Providers shall not be liable for any loss or damage of any kind, including indirect or consequential loss or damage, arising directly or indirectly out of a cancellation or abandonment of, or delay to, any tour, however caused.
9. Providers shall not be liable for any shortening of the tour or failure to complete the tour for any reason including: events compromising the safety of the group, sickness or illness of any kind to you or your party, weather related issues, or other unforeseen circumstances.
10. Providers reserves the right to refuse to carry any passenger, luggage or goods at its sole discretion.
11. Persons committing an illegal act or contravening Peruvian Health and Safety legislation (being a health danger to themselves or others) will be removed from the tour and no refund will be due.
12. Passengers under 18 years must travel with their parent(s) or guardian. There must be at least 1 parent or guardian for every 2 passengers under 18 years old. Proof of identification and age may be requested and failure to provide such proof may invalidate your ticket.
13. Providers will not be liable for the sickness of, injury to, or death of, any passenger, or the loss of, or damage to, any personal effects, whether caused by Providers’ negligence or otherwise. There is no travel insurance cover included in the price of a tour and LFT recommends that you obtain travel insurance to cover any sickness, injury, or loss that may occur while you are partaking in a tour.
14. Providers will endeavour to adhere to stated departure and arrival times but will not be liable for any failure to meet those times or for any cancellation or delay of providers’ services.
15. You agree to indemnify the provider against any loss, damage or expense suffered or incurred by providers, its officers, employees, agents or related companies as a result of any claim by any party whose claim arises from your tour or your acts or omissions while partaking in a tour.
16. Providers will not be liable for breach of, or any failure to perform its obligations under, these terms and conditions where such breach or failure is caused by anything beyond Providers’ reasonable control including, but not limited to weather conditions, war, civil commotion, hostility, acts of terrorism, strike, lockout, other industrial acts, weather phenomena or other acts of God, or governmental regulation or direction. Also, providers shall not be liable for any fortuitous event or force majeure, as provided in section 1315 of the Peruvian Civil Code.
17. If any part of these terms and conditions is held to be invalid, unenforceable or illegal for any reason, they will be deemed to be amended by the addition or deletion of wording necessary to remove the invalid, unenforceable or illegal part, but otherwise to remain unchanged to the maximum extent permissible under applicable law.
18. The legal relationship arising from this contract and every relationship arising between Peru Andes and their clients and / or users shall be governed and construed by the laws of the Republic of Peru.
19. The service reserve of Peru Andes involves submitting themselves to these terms and conditions, the laws of the Republic of Peru and the competence of the police, judicial and administrative authorities of the Republic of Peru.
